What to remember when holding property insurance with Compensa TU S.A.

§1 Insured party obligations during the term of the insurance contract

Breeders covered by protection under property insurance against fortuitous events (excerpt from Compensa TU S.A. property GTC):

"During the term of the insurance contract, the insured is obliged to comply with regulations aimed at preventing the occurrence of a loss, in particular:"
  1. Construction law provisions

  2. Fire protection law provisions

  3. Law provisions concerning standardisation, certification, construction and operation of technical devices and performance of technical supervision over those devices

  4. Manufacturer's recommendations regarding installation, operating conditions and use and storage of insured devices, and taking appropriate preventive actions and all reasonable precautions to minimise the risk of occurrence or aggravation of a loss

  5. Provisions of Annex No. 1 to the GTC (concerning protection of property against losses)

NOTE: Annex No. 1 is quite extensive and tailored to various types of activity, and not all of its provisions will apply to poultry production. Where the law provides for less stringent requirements, the provisions of Annex No. 1 to the GTC will not apply.

§2 Required periodic inspections and checks

Compliance with regulations aimed at preventing the occurrence of a loss consists in fulfilling the obligations set out in the table below. Please note the ownership status of the insured party, i.e. whether they are indeed responsible for obligations related to inspections.

§3 Obligations in the event of a fortuitous event

In the event of a fortuitous event, the policyholder and the insured are obliged to:

  1. Use available means to save the subject of insurance and prevent or reduce the extent of the loss

  2. Immediately notify the fire brigade, police or other services if the circumstances or type of loss require the presence of those services at the place where it occurred

  3. Immediately notify Compensa TU S.A. of the accident, stating, where possible, the cause, subject and scope of the loss, the circumstances of its occurrence and its estimated value

  4. Provide all explanations to representatives of Compensa TU S.A. and submit evidence necessary to establish the circumstances and extent of the loss, including accounting evidence

  5. Not alter the factual state at the place of the loss, including preserving damaged property and making it available to a representative of Compensa TU S.A. for inspection, unless necessary actions have been taken to secure property remaining after the loss or to reduce the extent of the loss.

    This provision does not apply if:

    • Compensa TU S.A. has not undertaken actions related to claims settlement within 3 business days of the date of notification

    • The estimated value of the loss does not exceed PLN 20,000, in which case the policyholder shall prepare and make available the following documents:

      • a list of losses

      • a detailed description of the event

      • photographs taken at the scene documenting the condition of the property immediately after the loss

§4 Inspection details — electrical installation

Inspection of electrical and lightning protection installations with regard to the condition of connections, fittings, protections and means of protection against electric shock, insulation resistance of conductors and earthing of installations and apparatus. The installation inspection should include visual inspection, measurements and operational tests (effectiveness of protection against electric shock measurements), and checking continuity of protective conductors.

During the inspection, the following should be checked in particular:

Inspection results should be kept for the period of use of the installation. Inspections should be carried out by persons holding qualifications required for supervision of the operation of devices, installations and power networks.

§5 Inspection details — gas installation and chimney ducts

Assessment of the technical condition of gas installations and chimney ducts (smoke, flue and ventilation) should include, among others, checking:

The inspection report should specify the technical condition of elements covered by the inspection, the extent of wear or damage, the scope of repair works and the order of their execution, methods and means of using elements exposed to harmful atmospheric influences, and the scope of repair works not carried out that were recommended in previous inspections.

§6 Annual vs. five-year inspection

The scope of annual and five-year inspections differs, except for the construction part of the annual inspection, which overlaps with the scope of the five-year inspection. If both inspections fall in the same calendar year, the owner or manager may carry out one inspection covering the scope of both the annual and five-year inspections.

Covers checking the technical condition of:

Five-year inspection (Art. 62(1)(2))

Covers checking the technical condition and fitness for use of the building, including:

Inspection of large-surface buildings (Art. 62(1)(3))

Applies to buildings with a built-up area exceeding 2000 m² or buildings with a roof area exceeding 1000 m². The inspection should be carried out at least twice a year — before and after the winter period, by 31 May and 30 November.
